1. Acceptance of Terms

By accessing and using the NESS website and services, you agree to these Terms of Use. If you do not agree with any part of these terms, you should not use our services.

2. Definitions

  • User: Individual or legal entity that accesses and uses our services
  • Services: All products, solutions and services offered by NESS
  • Platform: NESS website, applications and systems

3. Platform Use

By using our platform, you agree to:

  • Provide true, accurate and updated information
  • Maintain confidentiality of your access credentials
  • Not use the platform for illegal or unauthorized purposes
  • Not attempt to violate the security or integrity of systems
  • Respect NESS intellectual property rights

4. Services Offered

NESS offers the following services:

  • n.infraops: Infrastructure and ITIL help desk
  • n.devarch: Secure architecture and SDLC
  • n.autoops: AI automation and orchestration
  • n.privacy: Privacy and LGPD SaaS platform
  • n.cirt: Cyber incident response
  • forense.io: Digital forensics investigation
  • trustness.: Digital trust platform

5. Service Contracting

Service contracting is subject to a specific commercial proposal, which will detail scope, deadlines, values and conditions. Service provision begins after contract signing and/or acceptance of the commercial proposal.

6. User Responsibilities

The user is responsible for:

  • Ensuring service adequacy to their needs
  • Providing information necessary for service provision
  • Maintaining adequate environment for solution implementation
  • Complying with payment obligations
  • Respecting NESS intellectual property

7. NESS Responsibilities

NESS commits to:

  • Provide services according to contracted scope
  • Maintain qualified technical team
  • Ensure information confidentiality
  • Comply with applicable regulations
  • Provide technical support according to agreed SLA

8. Intellectual Property

All intellectual property rights related to the platform, methodologies, tools and NESS documentation are exclusive property of NESS. The user receives only a limited use license for contracted services.

9. Confidentiality

The parties commit to maintain confidentiality about sensitive information exchanged during service provision, except when disclosure is required by law or authorized by the owning party.

10. Limitation of Liability

NESS is not responsible for: (i) indirect damages, lost profits or consequential damages; (ii) failures caused by third parties or infrastructure not controlled by NESS; (iii) inadequate use of services by the user; (iv) fortuitous cases or force majeure.

11. Term and Termination

Contracts have a determined term according to commercial proposal. Early termination is subject to specific contractual conditions, including possible penalty and notice period.

12. Modifications

NESS reserves the right to modify these Terms of Use at any time. Changes take effect after publication on the website. Continued use of services after changes constitutes acceptance of new terms.

13. Applicable Law and Jurisdiction

These terms are governed by Brazilian laws. The jurisdiction of São Paulo/SP is elected to resolve any disputes arising from these terms.
